Conditions of Sale

Unless varied by written endorsement goods are sold upon the following conditions which shall supersede any conflicting terms in your order.

1)                  PRICES are subject to a revision at any time after the date of any quotation due to any change in the costs incurred by ourselves.

2)                  PAYMENT will be as stated on the quotation given. Default of payment shall entitle us to treat any outstanding orders as cancelled.

3)                  DELIVERY shall be when the goods are acceptable by a representative of your company, whether delivered or collected. Delivery dates are given in good faith and we shall do our best to comply, but we accept no liability for deviation from these dates due to reasons beyond our control i.e. strikes, act of God, material shortages etc. We reserve the right to deliver in instalments.

4)                  OWNERSHIP shall pass upon payment in full for all goods and packaging supplied. You are liable for any damage, loss or claim howsoever caused during the period from receipt to payment.

5)                  VARIATION OF QUANTITY is permissible up to 10% above or below that ordered. Actual quantities delivered will be charged.

6)                  DELAYED ACCEPTANCE. Goods not accepted 30 days after we have notified you of completion will be invoiced subject to normal payment terms. Storage will be charged and goods will be held at your risk.

7)                  RETURNABLE PACKAGING will be charged when the goods are invoiced and credited when returned to ourselves.

8)                  CLAIMS for damage, partial loss or any other reason is to me made within 14 DAYS from receipt in writing.

9)                  LIABILITY. The rights made by these conditions shall replace all common law statutory or other warranties or conditions whether implied or expressed. We cannot accept liability for any consequential loss or damage howsoever arising. Our rights shall not be affected by any indulgence or forbearance to you. No waiver by us or any breach shall operate as a waiver of any later breach.

10)              QUOTATIONS are subject to your written order and in no way constitutes a contract.

11)              ENGLISH LAW applies. Any dispute shall be referred to arbitration in accordance with the arbitration act 1950.
